Cormac’s cycling accident claim settled for £30,000

Road traffic accident case study.

Cormac was cycling along a main road in Belfast City Centre when a car emerged from a side road into his path. He managed to swerve to avoid a collision, but in doing so, lost control and fell off his bicycle. The impact with the road was hard and several injuries were sustained. Cormac suffered a fracture to his arm, multiple soft tissue injuries and experienced psychiatric injuries. As a consequence of the road traffic accident resulting in injury, the police were called and attended the scene. It took months for Cormac to recover and as a self-employed person, he suffered loss of earnings during this time. 

Bicycle accident personal injury claims

Cormac instructed Harry McAleese of McCartan Turkington Breen with the intention of pursuing bicycle accident compensation. Harry sent a letter of claim to the driver who refused to accept responsibility. They instead blamed Cormac for falling off his bicycle. Following various enquiries, Harry managed to obtain CCTV footage of the area. He also obtained a witness statement from a pedestrian that was walking by and a police report from the Police Service of Northern Ireland (PSNI). We then issued court proceedings and eventually liability was conceded by the driver, in face of the mounting evidence in Cormac’s favour.

To understand the full extent of Cormac’s injuries, we had him examined by a consultant orthopaedic surgeon and a consultant psychiatrist. Harry also collated documentation from Cormac that we could use to work out how much in earnings he lost due to the road traffic accident. At this stage, we invited the defendant to enter settlement negotiations wherein Harry negotiated a sum of £30,000 in compensation for Cormac. Our client was delighted with the amount of compensation awarded. He was also very pleased the case settled without the need for a hearing, as he was anxious about the possibility of having to attend Court
