Road traffic accident case study
Isobel was a seated passenger on a bus that was travelling through Belfast city centre. Another driver recklessly swerved into the path of the bus and the driver was forced to brake heavily. Isobel is an older lady and was unable to brace herself. She was thrown forwards from her seat into the rear of the seat in front. As a result of this accident, Isobel suffered injuries to both her arm and back. The dangerous driver who was responsible for the accident did not stop. The accident was distressing for Isobel and she was left very shaken.

A relative recommended McCartan Turkington Breen Solicitors to Isobel. She contacted us and had the benefit of a free initial consultation with Harry McAleese. He took the details of the accident and lodged a claim with the Motor Insurers’ Bureau (MIB). He did so because the liable driver could not be tracked down and Isobel was therefore required to pursue an untraced driver claim. The MIB will use its vast resources to investigate a road traffic accident involving untraceable drivers to attempt to identify them. If they are unable to, they will accept the burden of the claim. In this instance, the MIB agreed to deal with Isobel’s claim.
Harry had Isobel examined by a consultant in A&E medicine and a consultant psychiatrist who provided medical reports that detailed the extent of the injuries. Given the age of his client, Harry also arranged a full scan to rule out any more significant injuries.
Harry entered negotiations with the MIB who agreed to pay Isobel the sum of £14,000 in compensation.
Isobel was delighted with the outcome and regained much of her confidence to travel independently. Unfortunately, the liable driver was never identified.
