Work accident case study
Kim was delighted when she started a new job at a supermarket. During her first week, she was tasked with stocking shelves. She was asked to carry boxes from one storage unit to another. Unfortunately, when she lifted the heaviest box, she lost her balance and fell.
Kim had not been provided with manual handling training.
As a result of the accident, Kim suffered a back injury and psychological upset.
The injured worker contacted McCartan Turkington Breen’s personal injury team
In pain and frustrated by what had happened to her, Kim contacted our personal injury claims department. She had the benefit of a free initial consultation with Eimear Cathcart and was satisfied that she wished to proceed with a claim.
It was clear to Eimear that the supermarket was negligent having not provided Kim with the appropriate manual handling training. Her aim was to settle the matter quickly and spare Kim a lengthy litigation process.
Eimear sent a letter of claim to the supermarket and arranged medial appointments with a consultant in emergency medicine and a consultant psychiatrist.
Eimear invited the supermarket to settlement negotiations
Eimear entered into settlement negotiations with the supermarket’s representatives and the matter was resolved without issuing Court proceedings.
The case settled for over £12,000, plus Kim’s legal fees.
