Case Study: Work Accident Claim
Niamh was at work and making her way down a hallway when she slipped on a wet floor. She fell with force and suffered injuries to her back, hip and leg as a result.

As Niamh wished to proceed with a claim, Courtney took initial instructions and sent a letter of claim to the employer. Courtney also obtained medical reports from a consultant in emergency medicine, orthopaedic surgeon and consultant psychiatrist.
The employer denied liability
Liability was disputed by the Niamh’s employer who argued that they had reasonable systems of cleaning and inspection in place and that they did what was required of them to make sure hallway floors were safe and free of slipping hazards.
The employer also argued that, if the floor was in fact wet, our client should have been more cautious when walking along the hallway and that it was her fault that she failed to notice the wet floor.
Niamh rejected this and Court proceedings were issued.
Settlement negotiations
Despite the dispute, the employer indicated willingness to settle the matter without going to Court. We entered into negotiations and agreed on a settlement figure that all parties felt was reasonable. The matter settled for £16,000 plus Niamh’s legal fees.
