Employee awarded £12,500 in unfair dismissal and race discrimination case
McCartan Turkington Breen Employment Solicitor, Judy Hamilton, recently acted on behalf of an employee in an unfair dismissal and race discrimination case in which the employee was awarded over £12,500.00. The Tribunal found that the employer had subjected him to racial discrimination and had unfairly dismissed him. It also held that the employer had not provided the employee with written particulars of employment.
The employee alleged that he was being mistreated and discriminated against because of his race, whilst the employer alleged that the employee had resigned by requesting a move to a different department due to his concerns around the safety of overloaded lorries. It also alleged that he was on a zero hours’ contract and that it did not have any hours to offer him. The Tribunal did not accept these explanations and held that the employee had been unfairly dismissed by the employer who failed to follow the statutory dismissal procedures in dismissing the employee.
