Mental Health & Disability Discrimination- Do You Know your Rights?

In Northern Ireland, 1 in 5 adults and around 45,000 children suffer from a mental illness at any one time. This staggering rate is the highest in the UK and we need to be confident that our Health Trusts are providing the best treatment possible for mental health sufferers.

Just this week, the Belfast Health Trust awarded £5,500 to a 19 year old woman who suffered from agoraphobia. Her condition prevented her from leaving the house and she had recently been diagnosed with Asperger Syndrome. The Trust discharged her from their care after she failed to attend 2 appointments.

The Trust strictly enforced their penalty for missing appointments before following guidelines and investigating the reasons for her non-attendance. They accepted that they had breached their obligations under the 1995 Disability Discrimination Act and apologised to the woman for causing upset, distress and injury to her feelings.
