If you are unfortunate enough to become involved in a road traffic accident with an uninsured vehicle or a hit & run vehicle, you might feel that your situation is quite hopeless. However, in these instances, all is not lost. You may still be able to claim compensation through the Motor Insurers’ Bureau (MIB).

The MIB was founded shortly after World War 2 for the purpose of compensating victims of accidents caused by uninsured or untraced vehicles. They operate three distinct schemes to achieve this. The MIB is funded by an estimated £30 a year from every insured driver’s premium.

The Untraced Drivers Scheme (hit & run drivers)

The Untraced Drivers Scheme applies when you are involved in a road traffic accident and the driver/vehicle fled the scene of the accident. The accident could involve damage to your vehicle or other property, as well as injuries to you. It is a criminal offence to flee the scene of an accident and the Police Service of Northern Ireland (PSNI) may wish to investigate should it happen.

Sometimes this results in the identification of the fleeing driver/vehicle. But, if not, the Untraced Drivers Scheme may be available to you.

The Uninsured Drivers Scheme

The Uninsured Drivers Scheme applies when a road traffic accident was caused by a driver that did not have an insurance policy in place. Proving liability is still a requirement, however once established, the Scheme enables an avenue to receive damages.

The MIB recognise that the innocent driver has the right to pursue access to justice by way of deserved compensation. Put simply, it’s not your fault if another road user fails to meet their legal obligation of obtaining insurance. This extends not only to drivers, it would be available to pedestrians, passengers or the owner of any damaged property

The Green Card Scheme

The Green Card Scheme applies when an accident was caused by a foreign motorist. In the majority of cases, foreign motorists are fully insured, even if they are in a hire vehicle whilst on holiday to Northern Ireland. However, should no insurance policy exist, the MIB may be able to compensate you.
